Policies and Filing Complaints

Step One: Informal Complaint Process

The County Office of Education (COE) has the primary responsibility to ensure compliance with applicable state and federal laws and regulations governing its educational programs. The County Superintendent encourages the early resolution of complaints whenever possible. To resolve complaints that may require a more formal process, the County Superintendent and County Board adopt the uniform system of complaint processes specified in 5 CCR 4600-4670 and any related procedures approved by the County Superintendent of Schools.

All complaints should be initiated at the earliest level. The initial step should always begin with the immediate supervisor of the department, school site, or program. If attempts to resolve at this level are unsuccessful, the district has processes available to assist with resolution through a formal level. 

Complaints concerning school site personnel (teachers, classified staff, parents, students, programs, etc.) should be directed to the appropriate Assistant Principal/Principal.

Complaints concerning District programs should be directed to the appropriate department/person in charge of the program.

Complaints concerning District Administrators (Principals, Directors, Coordinators, etc.) should be directed to the Human Resources Department.

Step Two: Formal Complaint Process

A) Complaints Concerning County Office Employees

Concerns raised by parents/guardians about county office personnel should be resolved as quickly as possible. Therefore, parents or guardians of students attending SMCOE school programs are urged to discuss their concerns directly with the employee(s) in question when concerns surface. If this does not solve the problem, please complete the Complaints regarding District employees form found here and submit to Tami Moore, Associate Superintendent, Human Resources.

B) Uniform Complaint Procedure Notices and Forms (UCP)

A Uniform Complaint shall be used to investigate and resolve any complaint that alleges a violation of federal or state laws or regulations related to the following:

  • Unlawful discrimination, harassment, intimidation, or bullying based on actual or perceived disability, gender, gender identity, gender expression, sexual orientation, nationality, race or ethnicity, religion, sexual orientation.

  • Bullying or hazing.
  • Complaints alleging failure to comply with state or federal law in adult basic education, consolidated categorical aid programs, migrant education, vocational education, child care and development programs.
  • LAU violations

C) Williams Complaint

A Williams Complaint shall be used to investigate and resolve any complaint related to the following:

  • Insufficient textbooks and instructional materials;
  • Teacher vacancy or misassignment; and
  • Facility conditions.
